Timeless Trails France – Booking Conditions
These Booking Conditions form the basis of your contract with Timeless Trails France SAS (“the Company”). Please read them carefully before making a booking.
1. Booking and Contract
A booking is confirmed when the Company receives a completed booking form and the required deposit. The person making the booking confirms that they have the authority to accept these Booking Conditions on behalf of all members of the party.
A binding contract comes into existence when the Company issues a written booking confirmation.
2. Price of Your Holiday
All prices are quoted in GBP unless otherwise stated.
The Company reserves the right to adjust prices prior to confirmation of a booking. After confirmation, prices may only be altered in accordance with the provisions of the French Tourism Code.
3. Deposit
A deposit is required at the time of booking in order to secure your holiday. The amount of the deposit will be specified at the time of booking and deducted from the total price.
4. Balance Payment
The balance of the holiday price must be paid no later than six weeks before the departure date, unless otherwise specified.
If the balance is not received by the due date, the Company reserves the right to cancel the booking and apply the cancellation charges set out below.
5. Changes by the Client
If you wish to make changes to your booking after confirmation, the Company will endeavour to assist where possible. An administration fee may apply, and any additional costs incurred must be paid by the Client.
Where permitted by applicable law, a Client may transfer their booking to another person who satisfies all conditions applicable to the trip, subject to reasonable notice and payment of any costs incurred.
6. Cancellation by the Client
All cancellations must be notified in writing. Cancellation fees are calculated based on the date the written notice is received.
Indicative cancellation charges:
More than 42 days before departure: deposit retained
42 to 21 days before departure: 30% of the total price
20 to 8 days before departure: 50%
Less than 8 days before departure or no-show: 100%
In accordance with Article L211-14 of the French Tourism Code, no cancellation fees will apply where unavoidable and extraordinary circumstances significantly affect the performance of the package.
7. Changes Made by the Company
The Company may occasionally need to modify certain elements of the trip before departure.
In the event of a significant change, the Client will be informed as soon as possible and may accept the modification, choose an alternative trip where available, or receive a full refund of all sums paid.
8. Cancellation by the Company
If the Company cancels the trip (except in cases of unavoidable and extraordinary circumstances or fault by the Client), the Client will receive a full refund in accordance with the French Tourism Code.
Certain trips may require a minimum number of participants. If this number is not reached, the Company reserves the right to cancel the trip and will inform Clients within the time limits required by law.
9. Health, Fitness and Participation
Clients are responsible for ensuring that they are physically capable of undertaking the itinerary described.
The Company reserves the right to refuse participation in an activity if the guide reasonably believes that a Client’s health or safety may be at risk.
10. Client Behaviour
Clients are expected to behave in a reasonable and respectful manner throughout the holiday. The Company reserves the right to terminate a Client’s participation in the trip if their behaviour causes danger, distress, or serious inconvenience to others.
In such cases no refund will be provided and the Client will be responsible for any additional costs incurred.
11. Travel Insurance
Clients are strongly advised to obtain comprehensive travel insurance covering cancellation, medical expenses, personal liability, and repatriation.
12. Travel Documents and Health Requirements
Clients are responsible for ensuring that they possess valid passports, visas, and any other documents required for travel. Clients must also comply with any health or vaccination requirements applicable to the destination.
The Company cannot be held responsible if a Client is unable to travel due to failure to comply with these requirements.
13. Damage to Property
Clients may be held responsible for any damage caused to accommodation, equipment, or other property during the trip.
14. Third-Party Services
Optional excursions or services purchased locally and not included in the package travel contract are not part of the package organised by the Company. Any contract for such services is concluded directly between the Client and the supplier concerned.
15. Assistance to Clients in Difficulty
If a Client experiences difficulties during the trip, the Company will provide appropriate assistance, including information on health services, local authorities, and consular assistance where necessary.
Where the difficulty is caused intentionally or through the Client’s negligence, the Company may charge reasonable costs for this assistance.
16. Complaints
If you experience a problem during your holiday, please inform the Company or your guide as soon as possible so that the issue can be addressed promptly.
Any complaint not resolved during the trip should be submitted in writing within 28 days of the end of the holiday.
17. Liability
The Company’s liability for the proper performance of the travel services included in the package is governed by the French Tourism Code and applicable European legislation relating to package travel.
18. Data Protection
Personal data provided to the Company will be processed in accordance with applicable data protection laws and used solely for the purposes of administering your booking and providing the travel services.
19. Governing Law
These Booking Conditions are governed by French law. Any disputes shall be subject to the jurisdiction of the competent French courts.
20. Standard Information Form
In accordance with the EU Package Travel Directive and the French Tourism Code, the Standard Information Form for Package Travel is provided separately and forms part of the contractual documentation supplied prior to booking.
